Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Doulaco platform and website (the "Service"), operated by The Doula Collective LLC ("Doulaco," "we," "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Doulaco provides scheduling, booking, client-relationship, contract, invoicing, and communication tools for doula agencies and their practitioners. We may add, change, or discontinue features over time.

2. Accounts and eligibility

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be at least 18 and able to form a binding contract. You are responsible for all users you invite to your organization.

3. Acceptable use

You agree not to misuse the Service — including no unlawful, infringing, harmful, or abusive activity; no attempts to breach security or access data you're not authorized to; and no use that violates the rights or privacy of others.

4. Customer and client data

You are responsible for the information you and your organization put into the Service, including client contact details and any health-adjacent information, and for having the rights and consents to do so. Our handling of personal information is described in our Privacy Policy.

5. Third-party services

The Service integrates with third parties including Google (Calendar), Stripe (payments), and messaging providers. Your use of those integrations is also subject to the applicable third party's terms. When you connect Google services, Doulaco's use of Google user data adheres to the Google API Services User Data Policy, including its Limited Use requirements.

6. Payments

Paid plans and payment processing (via Stripe) are billed as described at sign-up. Fees are non-refundable except where required by law. You authorize us and our payment processor to charge your chosen payment method for applicable fees.

7. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by The Doula Collective LLC and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. You retain ownership of your data.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, The Doula Collective LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless The Doula Collective LLC from claims arising out of your use of the Service, your data, or your violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or for operational or legal reasons. Upon termination, your right to use the Service ends; provisions that by their nature should survive will survive.

12. Changes

We may update these Terms; we'll post the updated version on this page and update the effective date. Continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.
